Ownership of Site; Agreement to Terms of Use

These Terms and Conditions of Use (“Terms of Use”) apply to the 502 Childcare website located at www.502childcare.com, as well as all associated pages operated by 502 Childcare, LLC and its affiliated childcare centers — Little Explorers Academy – Mt. Washington, Leap Frog Academy – Smyrna, and Whiz Kidz Academy – Southeast (collectively, the “Site”). The Site is the property of 502 Childcare, LLC (“502 Childcare”). BY USING THIS SITE, YOU AGREE TO THESE TERMS OF USE. IF YOU DO NOT AGREE, DO NOT USE THE SITE.

502 Childcare reserves the right, at its sole discretion, to modify, update, or remove portions of these Terms of Use at any time. It is your responsibility to review these Terms periodically. Your continued use of the Site after changes are posted signifies that you accept and agree to those changes.

Provided you comply with these Terms of Use, 502 Childcare grants you a personal, non-exclusive, non-transferable, limited license to access and use the Site.

Content

All text, graphics, photographs, videos, forms, downloadable documents (including enrollment packets, medical forms, and policy documents), logos, artwork, and other materials appearing on this Site (collectively, “Content”) are owned, controlled, or licensed by 502 Childcare. All Content is protected by copyright, trademark, and other intellectual property laws.

Except as allowed in these Terms of Use, no part of the Site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or publicly displayed without prior written permission from 502 Childcare.

You may use childcare-related documents purposely made available on the Site (such as supply lists, policies, handbook PDFs, or enrollment forms) only if you:

Do not remove any proprietary notices contained in the documents.
Use the documents solely for personal, non-commercial and informational purposes related to childcare enrollment or parent responsibilities.
Do not modify any of the documents.
Do not make additional claims, representations, or warranties regarding these documents.

Your Use of the Site

You agree that you will not:

● Use any robot, scraper, or automated tool to access any portion of the Site.
● Attempt to gain unauthorized access to any part of the Site or any server connected to it.
● Probe, scan, or test the vulnerability of the Site or interfere with security measures.
● Impersonate another person, including a parent, guardian, employee, or applicant.
● Interfere with the functioning of the Site or another visitor’s use of the Site.
● Use the Site for unlawful purposes, including attempting to obtain personal information about enrolled children or staff.

You further agree not to submit false information through any online form, including but not limited to tour requests, employment applications, enrollment forms, or contact submissions.

502 Childcare reserves the right to block any misuse of the Site.

Purchases; Additional Terms

Some sections of the Site, including Tuition & Enrollment, Parent Resources, or program information pages, may include additional terms, policies, and requirements relevant to parents and guardians. These additional policies form part of these Terms of Use.

If any conflict exists between these general Terms and specific written policies (such as enrollment agreements, tuition policies, medical requirements, or the Parent Handbook), those specific policies will control for matters related to childcare services.

Fees, policies, program descriptions, and availability of childcare services may be updated at any time without prior notice.

Accounts, Passwords, and Security

Certain features — such as parent portals, staff login systems, or application tools — may require you to create an account with a username and password. You are responsible for maintaining the confidentiality of your login information and for any activity occurring under your account.

You agree to notify 502 Childcare immediately of any unauthorized use of your account or any security concerns.

You may not use another person’s login credentials without their explicit permission. 502 Childcare is not liable for any damages arising from your failure to secure your login information.

Privacy

The 502 Childcare Privacy Policy applies to your use of this Site and is incorporated herein by reference.

By using the Site, you acknowledge that internet transmissions can be intercepted or accessed by unauthorized parties. While 502 Childcare uses reasonable measures to protect information, no online transmission is ever fully secure.

502 CHILDCARE DOES NOT GUARANTEE THAT THE SITE OR CONTENT WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY DEFECTS WILL BE CORRECTED. THE SITE AND ALL CONTENT ARE PROVIDED “AS-IS” AND “AS-AVAILABLE.”

502 CHILDCARE MAKES NO WARRANTY REGARDING THE ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH THE SITE, INCLUDING PROGRAM DESCRIPTIONS, TUITION ESTIMATES, AVAILABILITY, OR POLICIES. ALL INFORMATION IS SUBJECT TO CHANGE WITHOUT NOTICE.

502 CHILDCARE CANNOT GUARANTEE THAT FILES OR DOWNLOADS FROM THE SITE ARE FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

YOU ASSUME FULL RESPONSIBILITY FOR YOUR USE OF THE SITE.

Limitation of Liability

Except where prohibited by law, 502 Childcare will not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Site.

If 502 Childcare is found liable for any damages related to your use of the Site, the total liability shall not exceed $100.00 USD.

Some jurisdictions do not allow limitations of liability; therefore, these limitations may not apply to you.

Indemnity

You agree to indemnify and hold 502 Childcare, its owners, directors, employees, and affiliated childcare centers harmless from any claims, losses, liabilities, or expenses arising from your misuse of the Site or violation of these Terms.

Violation of These Terms of Use

502 Childcare may disclose information about you if necessary to investigate misuse, comply with legal requirements, protect staff or enrolled children, or enforce these Terms.

502 Childcare reserves the right, without prior notice, to terminate your access to the Site if you violate these Terms or engage in harmful behavior.

502 Childcare may also take legal action and recover attorneys’ fees and costs arising from your violation of these Terms.

Governing Law; Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Kentucky and the laws of the United States.

Any disputes relating to the Site shall be resolved in the state or federal courts located in Jefferson County, Kentucky, and you consent to such jurisdiction.

Any claim relating to the Site must be filed within one (1) year of the date the claim arises.

Void Where Prohibited

The Site is controlled from the United States. 502 Childcare makes no representation that the Site or its Content are appropriate or available in locations outside the United States. Any service or offer on the Site is void where prohibited by law.

Miscellaneous

You may not use, copy, or distribute any Content in violation of applicable laws.

If any provision of these Terms is deemed unenforceable, it shall be replaced with a valid provision that best reflects the original intent. The remaining Terms shall remain in full force.

These Terms constitute the entire agreement between you and 502 Childcare regarding use of the Site.

Failure by 502 Childcare to enforce any part of these Terms does not waive its right to do so later.

Feedback and Information

Any feedback submitted through the Site is considered non-confidential. 502 Childcare may use such feedback without restriction.
